What is illegal?
To name but a few:
 |
To
copy software (or any of its accompanying documentation, etc.);
|
 |
To
loan software in order that a copy be made or to copy software
while it is on loan – including a loan to a friend or colleague;
|
 |
To
run purchased software covered by copyright on two or more computers
simultaneously unless the license agreement specifically allows
it. |
Anton Piller Court Order
An Anton Piller Order is a court order granting the software owner
or representatives the right to enter premises, without notice,
and to search computer systems and seize computer equipment which
contains evidence of illegal software.
This powerful court order is granted to prevent individuals
or organisations using unauthorised software from erasing or destroying
that software or any related documentation before evidence can be
collected. If you do not have the ability to backup your data and
cannot source alternative equipment quickly, how can you and your
staff continue with daily processes and procedures?
To effectively address these vital management concerns, every organisation
must implement and stringently maintain an effective policy on software
licensing and registration.
Implementing a software register is a daunting task as it
not only entails identifying and recording software that is used
on each and every computer used by the organisation, it also means
verifying that a proper license for that copy has been registered
and proof or purchase can be established.
It also involves educating your employees on the risks involved
and appropriately disciplining employees (including termination)
who indiscriminately place the organisation at serious risk of prosecution.
Memuta can provide
management with a service to implement (if necessary) or update
your organisation’s software register.
We will perform the initial data capture of all software
installed on each of your computers, verify the accuracy of the
information captured and provide you with a comprehensive report
of your current software inventory.
We will also provide training for two (recommended) members
of your staff to maintain the information as part of their job description.
Alternatively or in addition, Memuta can regularly
visit your site(s) and perform an audit of the system.
Working as a team with your Finance staff, we can then reconcile
the installed copies of the software to licenses and invoices as
proof of purchase and registration.
When implementing a new software inventory management system, Memuta uses
specialised and proven software used by over a million users globally.
This software is purchased and licensed on a per-PC basis, installed
on server(s), workstations and standalone PCs and operates in the
background without individual User intervention.
The application collects, analyses and provides reports on
installed hardware and software assets.
An accurate software inventory register is a valuable information
database to support:
 |
Financial
planning and budgeting exercises for maintaining software at
state-of-the-art levels; |
 |
Software
Compliance Audits to ensure that all software used by your organisation
is properly licensed and registered; |
 |
Disaster
Recovery Planning procedures and processes. |
